These terms govern your use of groundupbags.com and any quote, sample request, or other inquiry you send through it. By using the site you agree to them. If you do not agree, do not use the site.

1. This is not an online store
The website is a catalog and information site. It does not complete consumer checkout, charge a card, or create a binding purchase by itself. Prices, MOQs, lead times, and “typical” payment terms on the site are indicative. A contract is formed only if we send a written quote or order confirmation and you accept it in writing (including email).
2. Product information
Product names, sizes, gauges, certifications, and breakdown windows describe the current intended range. Specifications can change by lot, print, and customer brief. Wholesale buyers should rely on the quote, the spec sheet, and the certificates we send for that SKU — not on marketing headlines alone.
In particular:
- Certifications are issued by independent bodies. Each product page lists the marks that apply to that product. Do not assume every SKU is home-compostable.
- “Compostable” means the product is designed and certified to break down under the composting conditions named in the relevant standard (industrial and/or home). It does not mean the product will break down in landfill, as litter, in water, or in ordinary storage.
- Municipal organics programs set their own acceptance rules. BPI certification does not guarantee that a given city or hauler will take the bag.
- Pet-waste, food-contact, anti-static, and agricultural products have extra limits stated on their listings. Those limits are part of the offer.
3. No medical, environmental, or legal advice
Journal articles, statistics, and problem statements about plastic waste are general information. They are not medical advice, a promise that using our bags will improve human health, or a guarantee of any environmental outcome at a particular facility. You are responsible for complying with local waste, labeling, and packaging rules in the markets you sell into.
4. Quotes, samples, and wholesale
Sample availability, freight, deposits, and Net-30 language on the site are starting points, not a credit approval. We may refuse or condition an order. Custom print, film, or tooling may require a deposit. Unless a written agreement says otherwise, samples remain our specification samples and are not a warranty that a production run will be identical in every visual respect.
5. Intellectual property
The GroundUp name, logo, site design, product names, and original copy are owned by us or our licensors. You may not copy the site, scrape it for a competing catalog, or use our marks in a way that suggests we certified or endorsed a product we did not make. Photographs credited to Unsplash, Pexels, or similar sources remain subject to those licences.
6. Acceptable use
You agree not to:
- Use the site or our materials to make false compostability, “plastic-free,” or health claims about products — ours or anyone else’s.
- Submit unlawful, infringing, or misleading content through forms or chat.
- Attempt to break, overload, or reverse-engineer the site, or to access it by automated means except ordinary search-engine indexing.
- Impersonate GroundUp or our customers.
7. Third-party services and links
Chat, form delivery, fonts, analytics, and outbound links (including certification bodies and social networks) are provided by other companies. Their terms apply to those services. We are not responsible for their content or availability.
8. Disclaimer
The site is provided “as is.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement as they relate to the website itself. Product warranties, if any, are only those stated in a written sales contract or required by law.
9. Limitation of liability
To the fullest extent permitted by law, GroundUp Bags and its people will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from the site or from reliance on general marketing copy. Our total liability arising from use of the website is limited to one hundred US dollars ($100). Some states do not allow certain limitations; in those states our liability is limited to the maximum permitted.
10. Indemnity
If you republish our copy, ignore a product limitation (for example, calling an industrially compostable mailer “home compostable”), or misuse the site, you agree to indemnify us against third-party claims, damages, and reasonable legal fees that result.
11. Governing law
These terms are governed by the laws of the State of Maryland, excluding conflict-of-law rules. Courts located in Maryland will have exclusive jurisdiction, except that we may seek injunctive relief anywhere to protect our intellectual property.
12. Changes
We may update these terms by posting a new version on this page. The “Last updated” date shows the current version. Continued use of the site after a change means you accept the new terms.
